Maintenance Agreement Terms & Conditions

 

     Our Planned Maintenance (PM) Agreement is not a warranty or guarantee of any kind. The agreement is only for regular scheduled, planned or routine maintenance and inspections for proper mechanical operation. Specifically it covers cleaning and adjustments of the unit to allow the unit to perform at it's best. It does not cover cleaning ducts or removing ductwork for inspection.

     We do not make any guarantee that the unit will not need repair or need additional cleaning or drain cleaning between the spring and fall cleanings. If system or drains should need additional cleanings, additional charges will apply. Broom Heating & Air (BHA), will not be responsible for any costs or damage caused by backed up drains or high utility bills. We will provide the labor and materials to inspect and clean the system only. We will install one standard disposable 1" thick fiberglass filter per unit serviced at no additional charge. Systems that are operated under harsh or unusually dirty conditions may require additional labor or materials to be cleaned properly. These services will be quoted on a per occurrence basis prior to the work being performed. BHA does not perform any testing for the presence of mold, bacteria or any other kind of organisms. Employees of BHA are not allowed or qualified to make any determinations or recommendations regarding mold. Any questions or concerns regarding mold should be discussed with an expert in mold remediation.

     Our Limited Lifetime Warranty coverage is as follows: If we charge to replace a part other than a compressor or a coil, while covered by our PM and the same part fails again, while unit is under our PM, we will replace it (the same part) free of charge. Warranty applies only to parts that were replaced by BHA and paid for by the customer.  This warranty is non-transferable, applies to the original owner, and becomes null and void if home is sold, unit is serviced or repaired by any company or individual, other than BHA, or if replacing the part would not make the unit operable. This warranty is void if this agreement is not paid in full each year prior to the expiration date, or any invoice for any work by BHA is not paid in full when due.  We also reserve the right, at any point, to refund the price of the original repair and void this warranty, or to withdraw the offer of the Limited Lifetime Warranty on any unit, prior to repair, for any reason whatsoever. The following are not covered:  Parts replaced under the manufacturer's warranty, cleaning, adjustments, normal/routine maintenance items or services, compressors, evaporator coils, condenser coils, parts on units damaged by lightening, power surge or droop, abuse, neglect, fire, flood, earthquake or any other physical damage or lack of preventive maintenance (if more frequent maintenance is required and not performed).

     BHA, will mail a reminder, to remind you to call and schedule your maintenance.  It is the customer's responsibility to call our office to schedule maintenance, even if a reminder is not received.  If both maintenance's are not performed prior to the expiration date, the maintenance may still be scheduled, although all other benefits stop on the expiration date.  No refund's will be given for 'missed' PM Visits.  Should any circumstances arise that BHA feels warrant a refund, the refund will be the difference between the amount paid, and the current price of PM's performed for customer's without a PM Agreement.  If agreement is for multiple units, then all covered units must be serviced at the same time due to multi unit discounts.  If separate trips are required, then additional service call fee will be charged based on current fees at time of call.  This agreement will automatically renew and we will mail an invoice for renewal.  If for any reason you don't want to renew, simply write 'Cancel' or 'Declined' on the invoice and return.  We will cancel the invoice and the maintenance agreement. Terms and conditions of PM agreements are subject to change without notice. BHA will make every effort to schedule your PM visit as you request, however, breakdowns take priority over PM visits. Therefore, we can not guarantee a PM visit time or date if breakdowns are heavy on the day your PM visit is scheduled. We reserve the right to cancel or withdraw this maintenance agreement at any time and prorate your refund for any unperformed maintenance visits at our sole discretion.
